If we took in consideration the spirit of the law,
Art. 289 would not do as it calls on the National
Council of Government (NCG) to form a Provisional
Electoral Council. The former entity no longer exists
and was to remain in function until februrary 7th 1988
according to Art. 285. Technically, the latter has its
meaning in light of the NCG.
These provisions were transitory, are today
unconstitutional and can't be of any use to the
current circumstance. If Ayiti needs to go with a
general election, as proposed, the authorities should
find a different route to organize it. For any
Provisional Electoral Council no matter how it is
formed is not only unconstitutional, but also fosters
fraudulent elections.
Another point to look at: one is not in politics
primarily for the collectivity. His/her individual
interest is the main priority. Only his/her
rationality forces him/her to integrate the collective
need in his/her political equation. Hence, Aristide
would have to neglect himself to agree on a general
election; and not one of his opponents would do it.
The presidency should not be in question for another
election. The man has to go his course as the
president until the end of his term. Proposing to
interrupt it would create further political frictions
to never resolve the problem.
Resolving a political conflict allows for imperfect
situation/result. Wanting it to be perfect is too
idealistic.
