Unfortunately the legal process of impeachment is not possible at this point
in time, as there is no functioning Parliament, and no effective Judiciary,
only a powerful Executive. The absence of a functioning Legislature, as well
as and an unbiased and effective Judiciary, is by design and not by
coincidence or a fluke. The Legislative elections of May 2000 were flawed,
and the subsequent elections were not held as a result of "Insecurity" and I
would assume the current state of the Country confirms why the subsequent
Legislative elections could not be held.
The Judiciary (including Law Enforcement) has been politicized. This leaves
the Executive with all the power. In essence, the Haitian Government is the
Executive, and is largely responsible for what has and is currently
happening to the country and its' people. Just because an Executive is
democratically elected does not me there is a true Democracy.
Under the current situation, the only Constitutional means for the Executive
to be removed from office would require his/her resignation, assuming that
the Constitutionality of any act is still an issue. This explains why many
are clamoring for the resignation.
In short, the longer the Executive remains, the deeper the hole he digs for
the people of Haiti, as well as him/herself.
The world is watching, and ultimately the world will determine who is guilty
and who is innocent of the acts and crimes which have so greatly influenced
the current state of affaires in Haiti.
