On January 1, 2004, the first independent Black nation in the world had its
200th Anniversary. Not long after, as a sign of the times and Empire's wrath,
on February 29, its first democratically elected president, Jean-Bertrand
Aristide was kidnapped by US Marines. Then, yesterday, on May 14, 2004, French
Foreign Minister, Michel Barnier, arrived in Port-au-Prince for the first time in
200 years of Haitian independence.

Sign the restitution petition to assure that the Haitian masses commemoration
of "this visit" and denouncement of rule by force shall be heard down the
annals of history.

Let it be known, to one and all, that the Haitian people's demand for the $22
billion, extorted and undeserved tribute to former enslaver France, is the
only Haitian souvenir the French Foreign Minister may take back to France from
Haiti in 2004.

Arrivée du ministre français des Affaires étrangères à Port-au-Prince

PORT-AU-PRINCE, 14 mai (AFP) - Le ministre français des Affaires

étrangères, Michel Barnier, est arrivé vendredi soir à Port-au-Prince pour

une visite de 24 heures en Haïti, la première d'un ministre français des

Affaires étrangères dans ce pays depuis son indépendance en 1804.


M. Barnier a été accueilli à l'aéroport international

Toussaint-Louverture par le ministre haïtien des Affaires étrangères Yvon

Siméon.


Le ministre doit rencontrer samedi matin les responsables militaires

français de la Force multinationale. La France participe avec 900 soldats

à la force internationale de 3.500 hommes, dont 2.100 Américains,

déployés en Haïti depuis début mars pour mettre fin aux violences.


M. Barnier se rendra ensuite, en hélicoptère, dans la localité de

Dessalines (nord-est de la capitale) pour examiner un projet de coopération

entre cette ville et l'association régionale française "Pays de Savoie

solidaires" avant de visiter à Port-au-Prince un orphelinat.


Des entretiens sont prévus avec le président par intérim Boniface

Alexandre puis avec le Premier ministre Gérard Latortue et quatre autres

ministres (Affaires étrangères, Justice, Intérieur et Economie et

finances).


Une brève rencontre est programmée avec des étudiants à la faculté

d'agronomie de Port-au-Prince en présence du délégué de la commission

européenne en Haïti, Marcel van Opstal.


M. Barnier rencontrera enfin des responsables de la société civile et

des partis politiques haïtiens à la résidence de l'ambassadeur de France

Thierry Burkard, où il s'adressera à des représentants de la communauté

française avant de repartir pour Bruxelles en début de soirée. -

The Haitian Lawyers Leadership Network hereby affirms the People of Haiti's
right to pursue their claim for 22 billion ransomed from Haiti, after its
independence, through gunpoint, by ex-colonial authority France and decries Gerard
Latortue's authority to denounce this claim.

Legal Incompetence: Mr. Gerard Latortue is legally incompetent, as a Prime
Minister and an un-Constitutional Prime Minister at that! to annul, by a
statement, actions taken by a democratically elected Haitian Head of State.

The Visits: On the occasion of Gerard Latortue's current visit to France,
and, in anticipation of the visit to Haiti, on May 15, 2004, of the French
Foreign Minister, an occurrence that has not taken place in 200 years of Haitian
History and sovereignty, the Haitian Lawyers Leadership reaffirms and reiterates
the Haitian people's right to seek restitution from France of the $22 billion
owed ( and counting at $34 per second) and hereby further asserts, decides and
agrees that the following statement shall be known and published far and
wide:


C’EST FOUTU (IT’S LOST) WITH LATORTUE

The case for restitution was launched by President Jean Bertrand Aristide on
April 7, 2003 during the Bicentennial commemoration of the death of Toussaint
Louverture. This demand, formulated in the presence of the people, the
dignified heirs of our ancestors, and in front of MUPANAH (Musée du Panthéon National
Haïtien, or The Haitian National Pantheon Museum) where the immortal souls of
the Black race repose in respect and dignity. Past and present were
intimately linked for a historic projection to the future.

"RESTITUTION", "REPARATION" - Two magic words which could have bandaged the
evils of colonialism and slavery. All the sons of the colonized not suffering
from amnesia, all the sons of the colonists enlivened with a liberation spirit,
greeted this call positively. The countries of the Caribbean and Latin
America, all of Africa and even certain European countries identified themselves
with this ever-legitimate step.

To that end, law offices were constituted and the concerned parties had even
begun to acquaint themselves with the documents. Yet, Mr. Gerard Latortue has
denounced this claim and summarily declared the case of Restitution is a
classified matter.

What heresy! Politically, he has no competence to make such a decision. Mr.
Latortue should recall that the case of restitution was introduced by a
democratically-elected president, dignified representative of the people, and true
guarantor of national sovereignty. From an international viewpoint, States are
involved in that action. How can a Prime Minister and what a Prime Minister!
annul, by a statement, actions taken by a Head of State?

The Haitian Constitution of 1987, Article 138, stipulates that the President
of the Republic of Haiti is the guarantor of national independence and
territorial integrity. It can't be understood how an individual claiming to be
Haitian could have such a whimsical attitude concerning such an important case for
the Haitian nation.

Mr. Gerard Latortue ("la tortue" literally meaning the turtle) walks too
quickly. Watch out!

Latortue you denounce the debt owed to Haiti by France ?! Hearing you speak
that way, makes one want to re-read Black Skin, White Mask by Frantz Fanon. At
Haiti's Prime Minister’s office, fortunately, la tortue's duplicity is
obvious. He is making decisions way over his head and is neither well in his own skin
nor well-masked. We repeat again, that at Haiti's Prime Minister’s office,
the Turtle is neither in his skin nor wearing a mask.

C’EST FOUTU AVEC LATORTUE


Le dossier de la restitution a été lancé par le président Jean Bertrand
Aristide le 7 Avril 2003 lors de la commémoration du bicentenaire de la mort de
Toussaint Louverture. Cette demande, formulée face au peuple, digne héritier de
nos ancêtres, et devant le MUPANAH (Musée du Panthéon National Haïtien) ou
dorment dans le respect et la dignité les immortels de la race noire. Le passé et
le présent étaient liés avec intimité pour une projection historique sur le
futur.

RESTITUTION REPARATION

Deux mots magiques qui pourraient panser les maux du colonialisme et de
l’esclavage. Tous les fils de colonisés, non amnésiques, tous les fils de colons
animés d’un esprit libérateur, ont bien accueilli cet appel. Les pays de la
Caraïbe et de l’Amérique Latine, l’Afrique toute entière et même certains pays
européens se sont reconnus dans cette démarche combien légitime.

A cet effet, des cabinets d’avocats ont été constitués et les partis
concernés avaient même commencé à prendre connaissance des pièces. Monsieur Latortue a
déclaré sommairement: « le dossier de Restitution est une affaire classée ».
Quelle hérésie ! politiquement, il n’a aucune compétence pour prendre une
telle décision. Que monsieur Latortue se rappelle que le dossier de la restitution
a été introduit par un président démocratiquement élu, digne mandataire du
peuple vrai garant de la souveraineté nationale. Au point de vue international,
des états sont engagés dans démarche. Comment un premier ministre, et quel
premier ministre ? pourrait résilier par une déclaration des engagements pris par
un chef d’ état.

La constitution de 1987, en son article 138, stipule que le président de la
république est le garant de l'indépendance nationale et de l’intégrité du
territoire. On comprend mal, qu’un individu, qui se veut haïtien, puisse avoir une
attitude si fantaisiste face a un dossier aussi important pour la nation
haïtienne. Attention Monsieur Gérard la tortue marche trop vite, à vous entendre
parler ainsi, on a envie de relire : Peau Noire, Masque Blanc » de Frantz Fanon.
A la Primature, heureusement, Latortue n’est ni dans sa peau, ni bien masqué.
