25103: JRAuguste: (Question): re 25022 and 24981 Neptune in jail (fwd)

From: JRAuguste1@aol.com

About Mr. Neptune detention:

Napoleonic law prevails in Haiti. Under such system, isn't the burden of
proving innocence placed on the accused?

Under most postings (in Corbett land) favorable to Neptune, one common
scheme appears to be that the IGH should release Neptune forthwith or prove
its

case against him. That would be compatible with common law, not Napoleonic law.

Isn't it correct that there is no presumption of innocence under the
Napoleonic Code (applicable in Haiti). Isn't it in fact just the contrary,
e.g.
that
once the state accuses you, you are guilty until YOU prove your innocence?

Can anyone please throw some light on this issue?
