Former Lavalas Prime Minister Yvon Neptune and 29 other personnes will be
tried according to the district attorney in charge of the investigation.
District Attorney Clunie Pierre Jules in charge of the La Scierie Affair has
concluded that there is enough evidence to prosecute in a criminal trial Prime
Minister Yvon Neptnue and 29 other personnes involved, including the former
minister of Justice and Interior, Calixte Delatour and Jocelerme Privert.
The
order also finds that there is not enough evidence to charge 35 other persons
investigated, including Jean Bertrand Aristide and his secretary of
communications, Mario Dupuy.
In the presentation of facts, the district attorney has rejected the charge
of genocide or combat used by others to characterize the violence of Februay
11, 2004. The district attorney speaks instead of a Massacre, establishing
the
fact that during the sad days of February 9 to 11, 2004 many innocent
defenseless people were assassinated in a cowardly manner by members of the
â??Bale
Wouzeâ?? organization directed by the former Lavalas Representative Amanus
Mayette,
by armed civilians having arrived from Port-au-Prince, and by Policemen of
which some were in a Helicopter belonging to the National Palace and were
shooting at people running away from the violence and trying to take refuge
on
Morne Calvaire, near La Scierie.
The district attorney dismissed the idea of a combat because there was no
armed revolt in St Marc. Policemen assigned to the St Marc department left
their barracks of their own will. The incident of the fire at the clinic of
Dr.
Yfto Mayette, cousin of Amanus Mayette, was simply part of the scenario
created to justify the agression, as admitted by the doctor himself.
This
incident was not authored by oponents of the Aristide Government.
The number of casualties is debated. The American Missionary Terry Snow who
attempted to intervene with Bale Wouze to save lives and gain peace, brought
pictures and suggested 100 death and 45 homes burned.
The statement from the district attorney establishes about 50 death. The
list of all the victims is incomplete. The 22 people killed and identified
are:
Brice Kéner Pierre Louis (killed and burned in La Scierie)
Francky Dimanche, Stanley Fortuné (killed at Morne La Scierie)
Yveto Morency (killed at Terre Blanche)
Anserme et Wilghens Petit-Frère (burned at Portail Montrouis)
Bosquet Faustin,Wislet Charles (killed at La Scierie)
Kénol St-Vil et Jonas Nelson (killed and burned at La Scierie)
Makens Louis.
Marc Antoine Civil, Jean Louis et Guernel Joseph (killed at
Frécyneau-McDonald)
Florette Solide,a pregnant woman and Fanès Dorjean (burned at Grand-rue,
in the Paultre residence)
Laurette Guillaume, Sandy Cadet, Gaston St-Fleur, Josias St-Fleur
(disappeared).
Two young women, Anne (34 ans), Kétia (22 ans), looking for their male
partners during the events were raped in the St Marc Police Station by members
of «
Bale Wouze ».
Three teenagers captured by « Bale Wouze », were tied together with a rope
and dropped from a helicopter at Amaniy-Les-Bains ; the bodies were retrieved.
Two other people were dropped decapitated from the helicopter.
Luc Paultre , and elderly man in his 80â??s suffered serious burns on12
février
when his home was burned down. Bale Wouze members named Somoza, Vickès, Ti
jean Claude, Ernst Pascal, Biron, Amanus, Armstrong invaded the home of
pasteur Daméus Anulaire to grab Kénol St-Gilles who had taken refuge after a
bullet
hit him in the leg. They threw him into a fire in the presence of his
mother.
Nickson François was tied to a Kamyonet and dragged around the town.
There is a police report dated 27 May 2005 according to which bones and
bodies were found in Montrouis and Etang Bois Neuf.
The incidence described above followed the 9 February visit to St-Marc of
premier ministre Yvon Neptune. He met with Amanus Mayette ; at the
commissariat de police and the two vice-mayors of St Marc. One of these Paul
Pollys,
claims that he had to leave the meeting because of the prime minister's
unresponsiveness to his suggestion for a peaceful resolution of the crisis
rather than
accepting the violent methods of « Bale Wouze ». The meeting continued with
Amanus Mayette who would lead the operations the next day. After the meeting
the
Prime Minister addressed Haitian and American journalists and announced that
he had just solved the problems and brought peace to St Marc.
Yvon Neptuneâ??s testimony contradicts other evidence collected during the
investigation, particularly concerning the role of Amanus Mayette as the key
player in the violence and on the relationship between the prime minister and
Amanus Mayette.They kept a close relationship during the incindents.
The file includes 146 pieces of evidence among them: letters of
complaints; transcriptions of witnesses, reports of invesgations done in the
area,
reports of multiple telephone conversations between Yvon Neptune, high
ranking
officials of the government, and of the CSPN, of thePolice during the
execution of the opérations.
From 7 to 11 February 2004, Yvon Neptuneâ??s cell phone, le 558-1631, was
used
during 34,187 secunds, or 9 hrs 33 mns 46 secs. 21,319 secs of that time
concerned calls to people in charge of the police, of security or of members
of « Bale Wouze » in Saint-Marc, including Amanus Mayette. People called
included: Jean Gérard Dubreuil, secretary of state for security ; Jean Robert
Esther, director of general services, in charge of finance for the police
PNH ;
Frantz Gabriel, police commissary, helicopter pilot ; Oriel Jean, chief of
security of the Palace; Amanus Mayette, main figure in « Bale Wouze » ;
Biron Odigé,
coordinator of Bale Wouze, customs director of the town; Barthélémy Valbrun
Jr, director of the security service of the National Palace (USP-USGPN- Cat
Team) ; Roland Dauphin (alias Black Ronald), self proclaim commissary during
the
events.
The prime minister used 60% his time on the phone to deal with issues
concerning St Marc. He had several conference calls with Jean Robert Esther,
Amanus Mayette et Frantz Gabriel. There were 20 calls from Roland Dauphin to
Jean
Robert Esther, on 11 february 2004 ; There were 2 calls from Biron Odigé
toJean Robert Esther ; several calls from Amanus Mayette to Frantz Gabriel ;
59 calls between Jean Robert Esther and the Prime minister ; 5 calls from
Jocelerme Privert toJean Robert Esther, 6 calls from PNH director, Jocelyne
Pierre, to Jean Robert Esther.
The district attorney therefore recommends that criminal trials be held
against he following individuals: Amanus Mayette, Biron Odigé, Roland
Dauphin
(alias Black Ronald), Figaro Désir, Ernest Pascal, Vikès Janvier, Jean
Claude
