DOMINICAN REPUBLIC: Continuing threats against defender of rights of
Haitians

Father (Padre) Pedro Ruquoy, defender of the rights of Haitian refugees and
workers  in  the  Dominican Republic, is increasingly being threatened as a
result of his work.

On  18  February  2001, an article by Pedro Ruquoy which denounced the mass
arrests  and  deportations of Haitians and Dominicans of Haitian descent by
the Dominican authorities was published in the national newspaper El Siglo.
Following  the publication of this article Pedro Ruquoy, a Belgian national
who  is  a permanent resident of the Dominican Republic, received anonymous
letters,  one of which declared "you are an intruder and a traitor".  On 14
April,  an  unidentified man armed with a knife, who claimed to be a member
of  the Dominican army, entered Pedro Ruquoy's house and threatened to kill
him.  After a few moments, the man left the house and was reportedly driven
off in a private vehicle.  Father Ruquoy lodged a complaint with the police
but no one was apprehended.

On  14  June,  during  a visit to a sugarcane plantation (batey) in Baoruco
province   where   Haitian   sugarcane  cutters  work  in  extremely  harsh
conditions,  Father Ruquoy was threatened by two individuals who warned him
not to return to the batey.  On 16 June, in the same plantation, two men in
a  car similar to his were stopped by seven men.  One of the men reportedly
told  the  others  "don't  kill him, he isn't the Father".   In response to
this  incident,  Father  Ruquoy again lodged a complaint with the police in
Neiba,  the  provincial capital.  Some men were arrested in connection with
the  incident,  but were released after 48 hours.  It is unclear whether an
investigation is underway.

In  August  2000, Father Pedro Ruquoy testified to the Inter-American Court
of  Human  Rights  regarding  the  treatment  of  Haitians in the Dominican
Republic.    Although   he   participated   only   as  a  witness,  Amnesty
International  believes that the intimidation against Pedro Ruquoy stems in
part from the misrepresentation of this testimony in the press as an attack
against  the Dominican government.  It has been used to imply that he poses
a real threat to the state and has led to public verbal attacks against him
by ultra-nationalist groups.

Following his declaration, the Inter-American Court called on the Dominican
government to take measures to guarantee the safety of Pedro Ruquoy.  Since
14 June he has been provided with police protection.

Recommended Action by the Human Rights Defenders Network:

1.   Please  contact bishops and other influential members of the church in
your  country  and  encourage  them  to  send  letters/faxes, in Spanish if
possible, to the Dominican authorities:

     -  expressing  concern at the continuing incidents and threats against
Father  Pedro  Ruquoy,  the  latest  being on 16 June in Batey 1, near Neiba
in Baoruco province;
     -  taking  note  of the fact that Father Ruquoy has been provided with
police  protection  but  emphasising  that this first step must now by
followed  by  an  full  and  impartial  investigation  and  that those
responsible for the incidents must be brought to justice;
     -  calling  on  the  authorities  to  denounce the threats and attacks
against  him,  and  to  make  a clear and unequivocal public statement
clarifying   that   Father   Ruquoy's   role   in  testifying  to  the
Inter-American  Court  of  Human  Rights was as a witness and not as a party
against the state:
     -  calling  on  the  government  to  publicly  recognize the important
contribution  of  the  work of human rights defenders to promoting the
respect  for  human  rights  and  the  rule  of  law  in the Dominican
Republic;
     -  reminding  the government that the right to defend human rights has
been  internationally  recognized and established in the principles of the
United  Nations  Declaration  on  the Right and Responsibility of
Individuals,  Groups  and  Organs  of  Society  to Promote and Protect
Universally  Recognized  Human  Rights  and Fundamental Freedoms, of 9
December 1998, and in three resolutions by the General Assembly of the
     Organization  of  American  States (AG/RES. 1671 (XXIX-O/99) of 7 June
1999,  AG/RES,  1711  (XXX-O/00)  of  5  June  2000  and  AG/RES. 1818
(XXXI-O/01) of 5 June 2001).

2.   Please  also  send  your  own  appeals  on  this  case,  following the

REPÚBLICA DOMINICANA: continuas amenazas contra un defensor de los derechos
de los haitianos

El Padre Pedro Ruquoy, defensor de los derechos de los refugiados haitianos
y  trabajadores  en la República Dominicana, está siendo amenazado de forma
creciente por hacer su trabajo.

El  18 de febrero del 2001, fue publicado en el periódico nacional El Siglo
un  artículo  del  Padre  Ruquoy  en  el  que denunciaba arrestos masivos y
deportaciones  de  haitianos  y  dominicanos descendientes de haitianos por
parte  de  las  autoridades  dominicanas.  Después de su publicación, Pedro
Ruquoy  -de  nacionalidad  belga  y  residente  permanente  en la República
Dominicana-  recibió  cartas  anónimas una de las cuales apuntaba: "eres un
intruso  y  un  traidor". El 14 de abril, un hombre armado no identificado,
que  dijo  ser miembro del ejército dominicano, entró con un cuchillo en la
casa  de  Pedro  Ruquoy  y amenazó con matarlo. Momentos después, el hombre
abandonó  la  casa  y supuestamente se fue en un vehículo privado conducido
por  desconocidos.  El  Padre  Ruquoy presentó una denuncia ante la policía
pero no se produjo ninguna detención.

El  14  de  junio,  durante una visita a una plantación de caña de azucar (
Batey),  en la provincia de Baoruco, donde los cortadores de caña de azúcar
haitianos  trabajan  en  condiciones de extrema dureza, el Padre Ruquoy fue
amenazado  por dos individuos que le advirtieron que no regresara al Batey.
El  16 de junio, en la misma plantación, dos hombres que conducían un coche
parecido  al suyo fueron interceptados por siete individuos.  Se recibieron
informes de que uno de los hombres dijo a los otros: " no lo maten, este no
es  el Padre". Como respuesta a este incidente, el Padre Ruquoy presentó de
nuevo  una  denuncia  ante la policía en Neiba, la capital de la provincia.
Varios  hombres vinculados con el incidente fueron arrestados pero 48 horas
después   fueron   puestos  en  libertad.  No  está  claro  si  hay  alguna
investigación en marcha.

En  agosto  del  2000,  el  Padre  Ruquoy  prestó declaración ante la Corte
Interamericana  de  los  Derechos Humanos referente al trato que sufren los
haitianos  en  la República Dominicana. Aunque sólo participó como testigo,
Amnistía  Internacional  cree  que la intimidación contra Pedro Ruquoy está
motivada  en  parte  por  la  tergiversación  que  la  prensa  hizo  de  su
declaración  formulándola como un ataque en contra del gobierno dominicano.
Este  hecho  ha  sido  utilizado  para  presentar  al Padre Ruquoy como una
amenaza  real para el Estado y ha resultado en ataques verbales públicos en
contra de él por parte de grupos ultranacionalistas.

Después  de  su  declaración,  la  Corte  hizo  un  llamamiento al gobierno
dominicano  para  que  emprendiera  medidas  con el objeto de garantizar la
seguridad  de  Pedro  Ruquoy.  Desde  el  pasado  14  de  junio  dispone de
protección policial.

Acción recomendada por la Red de Defensores de los Derechos Humanos:

1-  Envíen  cartas/faxes,  en  español  si  es  posible,  a las autoridades
dominicanas:
     -expresando  su  preocupación  por  los contiuos incidentes y amenazas
     contra  el Padre Pedro Ruquoy. El último incidente tuvo lugar el 16 de
     junio en Batey, cerca de Neiba, en la provincia de Baoruco;
     -apuntando  el  hecho  de  que  el  Padre  Ruquoy  ha sido provisto de
     protección   policial  pero  resaltando  que  este  primer  paso  debe
     completarse  con  una  investigación  imparcial  completa  y  que  los
     responsables de los incidentes deben ser llevados ante la justicia;
     - instando a las autoridades a denunciar las amenazas y ataques contra
     él y hacer una clara e inequívoca declaración pública clarificando que
     el  Padre  Ruquoy  compareció ante la Corte Interamericana de Derechos
     Humanos en calidad de testigo y no como parte en contra del Estado;
     -instando   al   gobierno   a  reconocer  públicamente  la  importante
     contribución  del  trabajo  de  los defensores de los derechos humanos
     para  promover  el  respeto de los derechos humanos y el imperio de la
     ley en la República Dominicana;
     -recordando al gobierno que el derecho a defender los derechos humanos
     ha  sido internacionalmente reconocido y establecido en los principios
     de  la  Declaración  de  las  Naciones  Unidas  sobre  el Derecho y la
     Responsabilidad  de  los  Individuos, Grupos y las Instituciones de la
     Sociedad  para  Promover  y  Proteger  las  Libertades de los Derechos
     Humanos y Fundamentales Universalmente Reconocidas, del 9 de diciembre
     de  1998  y  en  tres  resoluciones  de  la  Asamblea  General  de  la
     Organización  de  Estados Americanos AG/RES. 1671 (XXIX-O/99) del 7 de
     junio  de  1999,  AG/RES,  1711  (XXX-O/00)  del 5 de junio del 2000 y
     AG/RES. 1818 (XXXI-O/01) del 5 de Junio del 2001)

2-  Por  favor,  también  contacten  con  obispos  y  otros  representantes
influyentes  de  la  iglesia  en  su  país  y  animarlos  para  que  envíen
llamamientos  sobre  este  caso  siguiendo  las  recomendaciones explicadas
anteriormente.
